These Terms of Service (“Terms”) govern your use of the website and services provided by Apex Signature Solutions, LLC (“Apex,” “we,” “us,” or “our”). By accessing this website or using our services, you agree to these Terms.

1. Services

Apex Signature Solutions, LLC provides professional mobile notary services, estate planning notarial support, bookkeeping services, business formation assistance, litigation support and administrative coordination, and business administrative support services (“Services”).

Services requested, scheduled, or confirmed in writing, through our website, booking portal, email, or other communication methods constitute the agreement between you and Apex

2. No Legal or Tax Advice

Apex Signature Solutions, LLC and its representatives provide administrative support services and Texas-commissioned notarial acts only. We are not a law firm, accounting firm, or tax advisory firm and do not provide legal advice, tax advice, document drafting, legal interpretation, or determine which notarial acts are required.

Clients are solely responsible for:

  • Ensuring documents are complete and accurate

  • Determining the appropriate notarial act

  • Understanding the legal effect of their documents

3. Bookings, Confirmations & Cancellations

Booking

Appointments may be scheduled through our website, booking portal, email, or phone. Appointment confirmations will be provided once scheduling is completed.

Fees & Deposits

Service fees will be communicated at the time of booking or listed on our website. Certain services may require deposits or prepayment. Unless otherwise stated, payments are non-refundable.

Cancellations & Rescheduling

Cancellations made at least 24 hours before the scheduled appointment may qualify for rescheduling or partial refund consideration. Late cancellations and no-shows may be charged in full.

Travel Fees

Mobile notary travel within our designated service area may be included in pricing. Additional travel fees may apply for appointments outside our standard service area

4. Client Responsibilities

By using our Services, you agree to:

  • Provide accurate and complete information

  • Present valid government-issued identification for notarization services

  • Follow all notarial instructions provided during appointments

  • Refrain from signing documents before instructed by the notary

  • Ensure documents are complete prior to the appointment

Apex reserves the right to refuse service for incomplete, improper, suspicious, or unlawful requests

5. Remote Online Notarization (RON)

Apex Signature Solutions, LLC may offer Remote Online Notarization (“RON”) services in the future; however, RON services are not currently available.

If RON services become available, Apex will publish all applicable requirements, eligibility standards, consent procedures, recording disclosures, and technical requirements in accordance with Texas law and applicable regulations.

6. Fees, Payments & Refunds

Payment is due as communicated at the time of booking or completion of services. We may utilize third-party payment processors for secure transactions.

Refunds are issued only as outlined within these Terms, applicable service agreements, or at the discretion of Apex. Any disputed charges must be reported within 30 days of payment.

7. Intellectual Property

All website content, including text, graphics, logos, branding, images, templates, and materials, is the property of Apex Signature Solutions, LLC and may not be copied, reproduced, distributed, or used without written permission.

8. Confidentiality & Document Handling

We handle client information and documentation with professionalism and care. Documents and information provided to Apex will only be used for:

  • Performing requested services

  • Maintaining required compliance records

  • Fulfilling legal or regulatory obligations

  • Other authorized purposes approved by the client

Additional confidentiality or non-disclosure agreements may supplement these Terms when agreed upon in writing.

9. Disclaimer & Limitation of Liability

No Warranties

Services are provided “as is” and “as available” without warranties of any kind, to the fullest extent permitted by law.

Limitation of Liability

To the fullest extent permitted by law, Apex Signature Solutions, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use of our Services.

Total liability for any claim related to the Services shall not exceed the amount paid for the specific service giving rise to the claim.

Notarial Services Disclaimer

Apex performs notarial acts in accordance with applicable Texas law. We are not responsible for the legal sufficiency, legality, accuracy, or outcome of documents presented for notarization

10. Indemnification

You agree to indemnify and hold harmless Apex Signature Solutions, LLC, its owners, affiliates, contractors, employees, and representatives from any claims, damages, liabilities, costs, or expenses arising from:

  • Your misuse of the Services

  • Violation of these Terms

  • Negligence or unlawful conduct

11. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Texas. Any disputes arising from these Terms or the Services shall be resolved exclusively in courts located within Montgomery County, Texas.

Clients agree to contact Apex first to attempt resolution of any concerns prior to initiating formal legal action.

12. Termination

Apex reserves the right to refuse, suspend, or terminate Services for violations of these Terms, unlawful conduct, abusive behavior, or other lawful reasons.

Termination does not eliminate payment obligations for completed services or appointments not canceled within the required timeframe.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. Updated Terms will be posted on this website with a revised effective date. Continued use of the website or Services constitutes acceptance of any updates.

14. Severability

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
