Terms of Service (Terms)

These Terms of Service (“Terms”) govern your use of the Site and the Services provided by Apex Signature Solutions, LLC (“Apex,” “we,” “us,” or “our”). By using the Site or engaging our Services, you agree to these Terms.

1. Services

Apex offers mobile notarial services, remote online notarization (RON) services where eligible, attorney and legal support appointments, estate planning notarial support, bookkeeping, business formation assistance, and administrative/operational consulting (the “Services”). Services requested and agreed in writing or via our appointment/portal system form the contract between you and Apex.

2. No legal or tax advice

Apex and its representatives provide administrative services and Texas-commissioned notarial acts only. We are not a law firm and do not provide legal or tax advice, draft or interpret legal documents, or select notarial acts. You are responsible for confirming document readiness, determining the required notarial act, and understanding the legal effect of documents presented.

3. Bookings, confirmations & cancellations

  • Booking: Appointments may be scheduled via our booking portal, email, or phone. A booking confirmation will be sent.

  • Fees & deposits: Fees for Services will be communicated at the time of booking or on our Services page. Some services may require a deposit or prepayment. Fees are non-refundable unless otherwise stated.

  • Cancellations & rescheduling: Cancellations made [insert your policy—e.g., “within 24 hours”] before the appointment may be refundable or subject to a cancellation fee. Late cancellations and no-shows may be charged in full. (Customise this clause with your specifics.)

  • Travel & convenience fees: Mobile notary travel within our stated service area may be included, or a travel fee may apply; travel beyond our service area will incur additional fees.

4. Client obligations

You agree to:

  • Provide accurate information and any documents required for the Service.

  • Present a valid government-issued photo ID at notarization and follow the notary/RON instructions (do not sign documents before the notary instructs you to do so).

  • Ensure that documents are complete and the appropriate notarial acts have been determined prior to the appointment. Apex may decline to notarize incomplete or improper documents.

5. Remote Online Notarization (RON)

Apex may offer Remote Online Notarization (RON) in the future, but RON services are not currently available. If and when Apex offers RON, we will publish the RON service terms and requirements on our Site and obtain any required consents before conducting a RON session. RON sessions require identity verification, consent to audio/video recording, and compliance with applicable state law and technical standards; availability will be subject to eligibility and legal requirements in Texas and any other jurisdiction we choose to serve.

6. Fees, payment & refunds

  • Payment: Payment is due as stated at the time of booking or upon completion of the Services. We accept payment via the methods indicated at the time of booking. We may use third-party payment processors; your payment card information is managed by those processors.

  • Refunds: Refunds are issued only as described in your service agreement or at Apex's discretion. Disputed charges must be reported within 30 days.

7. Intellectual property

All content on the Site (text, graphics, logos, images, and software) is the property of Apex or its licensors and is protected by applicable intellectual property laws. You may not copy, reproduce, or use our trademarks or logo without our written consent.

8. Confidentiality & document handling

We handle client documents with care. Documents provided to Apex will be used only to perform the Services, to maintain compliance/audit records, or as otherwise authorized by you. For certain Services (e.g., bookkeeping or legal support), we may agree to additional confidentiality or non-disclosure terms; such terms, if agreed in writing, supplement these Terms.

9. Limitations of liability & disclaimers

  • No warranties: The Services are provided “as is” and “as available.” Apex disclaims all warranties to the fullest extent permitted by law.

  • Limitation of liability: To the fullest extent permitted by law, Apex’s total liability for any claim arising from or related to the Services, whether in contract, tort (including negligence), or otherwise, shall not exceed the fees paid by you to Apex for the particular Service that gave rise to the claim. Apex shall not be liable for indirect, incidental, special, consequential, or punitive damages.

Notary liability: We perform notarial acts according to applicable law. Apex is not responsible for the legal outcomes of documents notarized, nor for legal errors in documents that clients present for notarization.

10. Indemnification

You agree to indemnify and hold harmless Apex, its affiliates, officers, employees, and agents from any claims, liabilities, losses, damages, and expenses (including reasonable attorneys’ fees) arising out of your breach of these Terms, your negligence, or your misuse of the Services.

11. Refunds & dispute resolution

If you have a dispute or issue, please contact us at amber@apexsignaturesolutionsllc.com so we can resolve it. These Terms are governed by the laws of the State of Texas, without regard to conflict-of-laws principles. Any legal action must be brought in courts located in Montgomery County, Texas.

12. Termination

We may suspend or terminate access to Services for violation of these Terms or for other lawful reasons. You may terminate provision of Services by notifying us; termination does not relieve you of any payment obligations for Services already rendered or for scheduled appointments not timely cancelled under our cancellation policy.

13. Changes to these Terms

We may modify these Terms from time to time. We will post the updated Terms on the Site with a new effective date. Continued use of the Site or Services after changes constitutes acceptance of the updated Terms.

14. Severability

If any provision of these Terms is determined invalid, illegal, or unenforceable, the remaining provisions will remain in full force.
